Eddie Sheehy (News - Alert), CEO of Nuix, a technology company that enables people to make fact-based decisions from unstructured data, has labelled current eDiscovery technologies "too slow, incomplete, and inflexible" to address litigants' need to comply with the new rules of discovery.

Changes to the United States Federal Rules of Civil Procedure, slated to come into effect in December of this year, will increase courts' focus on making discovery proportional to the needs of the case and encourage co-operation between parties.

"Courts and customers alike are revolting against the out-of-control cost and scale of traditional discovery," said Sheehy. "The new federal rules will force attorneys to have a deep understanding of their case by the prediscovery stage of litigation. Many eDiscovery technologies simply cannot deliver this but Nuix (News - Alert) can. We're continuing to develop our capabilities to meet the changing needs of the legal community."

Mot eDiscovery technologies cannot process important evidence sources such as mobile devices, complex formats such as email archives, structured data such as business archives, and data in the cloud, Sheehy said. They also lack the analytics and visualizations to interrogate the content of the data and quickly drill down into the most relevant information. The end result is too many irrelevant documents going into review, and too many important ones being left out.



"Early case assessment technology needs to move beyond telling you how many documents you have per custodian-you need to know what the timelines are, what evidence you have, what risks that presents, and what information is missing," said Sheehy. "That way litigants and their legal teams can realistically assess the strength of their case and how much effort any discovery requests will involve."
